Divorce Lawyer
Divorce is the complicated legal process of ending a marriage. While the process is dictated by law, divorce cases are much more than legal proceedings and more often than not emotional stumbling blocks prolong the successful and amicable resolution of disputes.
Basically there are two types of divorce – uncontested and contested. In uncontested divorces, the parties reach agreement on all major issues and just need help to properly present a settlement agreement and related required documents to a court for approval (or modification) as the judge requires. This process usually only takes 30-60 days once the proper paperwork is presented. In a perfect world, all divorces would be uncontested.
But this is not a perfect world and many divorces are contested ... meaning there are unresolved issues between the parties at the time of filing for divorce. These issues include child support and custody, alimony and equitable distribution of assets and liabilities. If any of these issues cannot be amicably resolved, then the divorce will be considered contested.
Because divorce is such an emotional and traumatic process, the fallout from the issues that created the need for divorce -- financial problems, anger, bad behavior, infidelity -- can push a divorce down the contested path. Regardless of the issues in your marriage, if you and your spouse cannot resolve your differences (and the four major areas of all divorces) your case will remain contested until it is heard and decided by a judge.

The Process
When you first meet with us, Lynn Hamilton Johnson will explain the process in detail and discuss options with you. Once she has a clear understanding of your case. and we have gathered enough information from you about your situation, we will start building your case.
The first step is a separation agreement prepared to address important issues, including:
- Child custody and visitation
- Child support
- Spousal support/alimony
- Division of property
- Debts
- The marital home
- Retirement accounts and pensions
The specifics of your case will dictate how these issues are decided. For example, factors such as domestic violence, cruel treatment, child abuse or adultery could play a role in deciding how marital assets are divided. On the other hand, if we can provide detailed evidence, debts can be allocated depending on each spouse's spending habits.
Even though many divorces are contested, and Lynn Hamilton Johnson is skilled at arguing even the most complex cases in court, not every case requires hard-nosed litigation. Lynn Hamilton Johnson knows Georgia law, knows the system, knows the courts and will always attempt to negotiate or mediate a settlement. However, if this approach fails she is not afraid to fight for your rights and the rights of your children in court.
First and foremost, we always put you and your family first , especially when there are children involved.
